The Rights of the Farmers over Seed – the Indian Seed Law as a Model for Developing Countries


Suman Sahai's study paints a clear picture of how the Plant Varieties Protection and Farmers´ Rights Act was fought for by farmers, explains its content and what it means to Indian farmers. It provides us with an insight on which farmers' rights it is worth working towards in developing countries.

The Indian regulation also led to a draft of a framework for an international convention that could be an alternative to UPOV and would protect farmers' rights to seeds as well as breeders' rights (the socalled CoFaB).

In the EU, highest priority must be given by NGOs to the political objective of preventing India's forced membership in UPOV as a result of the free trade agreement with the EU. A similar NGO initiative in Norway was successful: this passage was deleted from the draft for a free trade agreement between EFTA and India. Let us follow the Norwegian example here in the EU.
